FVW Photography Terms and Conditions

These Terms and Conditions Agreement are made between FVW Photography (Photographer) and the client(s) for the provision of photography services as described in the Agreement. By signing this contract, both parties agree to the following terms:

1. Services Provided

The Photographer agrees to provide photography services, including but not limited to [list the services, such as event photography, portrait photography, wedding photography, etc.] as detailed in the attached proposal/quote or in the communication with the Client.

2. Booking and Payment

  • Deposit: A deposit of £100 is required to confirm the booking. The deposit is non-refundable unless the Photographer cancels the booking.

  • Payment: The remaining balance is due 48 hours before the scheduled event or session date.

  • Late Payments: Any payments made after the due date will incur a 20% late fee for each day overdue.

3. Cancellations and Rescheduling

  • Client Cancellation: If the Client cancels the session, the deposit will not be refunded. If cancellation occurs less than 7 days before the event/session, the full payment will be due.

  • Photographer Cancellation: In the event of an unavoidable cancellation by the Photographer, a full refund of any amounts paid will be issued, or the Photographer will work to reschedule the service at no additional cost.

  • Rescheduling: If the Client wishes to reschedule, they must notify the Photographer at least 30 days before the original session date. Additional charges may apply if rescheduling is requested within a shorter time frame.

4. Client Cooperation

The Client agrees to provide necessary cooperation, including but not limited to:

  • Communicating their vision, preferences, and any specific requests for the session.

  • Ensuring the location for the shoot is available and accessible.

  • Providing necessary permissions for photography at the venue or any location, including location fees (if applicable).

5. Intellectual Property Rights

  • Ownership: The Photographer retains all copyright and intellectual property rights in the images created during the session. The Client is granted a license to use the images for personal purposes only, including printing and sharing on social media, unless otherwise specified.

  • Commercial Use: The Client may not use the images for commercial purposes (such as advertising or resale) without the prior written consent of the Photographer.

6. Image Delivery and Usage

  • Turnaround Time: The Photographer will provide the edited images within 3 weeks of the session date. The Client will receive the images via [method of delivery by online gallery].

  • Use of Images: The Photographer reserves the right to use the images for promotional purposes, including but not limited to websites, social media, portfolios, and marketing materials unless otherwise agreed upon in writing by both parties.

7. Limitation of Liability

  • The Photographer is not responsible for any injury, accident, loss, or damage that may occur before, during, or after the photoshoot or event.

  • The Photographer’s liability for any breach of this Agreement or negligence will be limited to the total amount paid by the Client for the photography services.

8. Force Majeure

Neither party shall be held liable for failure or delay in performance due to causes beyond their control, such as accidents, weather, illness, or other unforeseen circumstances.

9. Travel and Accommodation

  • Travel Fees: If the session or event is outside of 20 miles from Barnsley South Yorkshire, travel fees may apply. These fees will be detailed in the proposal/quote.

  • Accommodation: If overnight accommodations are required, the Client agrees to cover accommodation expenses for the Photographer and any assistants.

10. Client Approval

  • The Client acknowledges that the Photographer has the creative discretion to compose and edit the images. Any requests for specific edits, retouching, or additional work may be subject to additional charges.

  • In the event the Client is not satisfied with the final product, the Photographer will make reasonable efforts to address concerns, but no refunds will be issued after the final images have been delivered.

11. Governing Law

This Agreement will be governed by the laws in accordance with the laws of England and Wales.

12. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements, whether written or oral. Any changes or amendments to this Agreement must be in writing and signed by both parties.
